User-Generated Content Policy

Purpose

This policy outlines how Ferm Living ApS collects, uses, and stores user-generated content (UGC) from social media platforms, including Instagram, for marketing purposes. The policy ensures that the use of such content complies with applicable laws, including the Danish Marketing Practices Act, the Copyright Act, and the General Data Protection Regulation (GDPR).

What is User-Generated Content (“UGC”)?

UGC includes images, videos, texts, and other content created and published by users—typically customers or followers—that mention or tag our brand, products, or services.

Obtaining Consent

We do not use user-generated content for marketing without prior explicit and informed consent from the content creator. We document and store the consent in accordance with GDPR.
Any personal data contained in UGC is processed in accordance with Ferm Living’s Privacy Policy and in compliance with the GDPR.

Rights and Usage

By granting consent, the user provides Ferm Living ApS with a non-exclusive, royalty-free, worldwide license to use the content for marketing purposes, including:

  • On our websites and webshops
  • In emails and newsletters
  • On our social media channels
  • In paid advertisements

The content will always be used with respect for the creator and in a context that is not offensive or misleading.
Ferm Living may use, edit, crop, or adapt the content for use across different media and formats, but we will always respect the integrity of the content.

Credit

We always credit the creator when using UGC, unless otherwise agreed. Credit is typically given by mentioning the Instagram username.

Withdrawal of Consent

Users may withdraw their consent at any time by contacting us at info@fermliving.com. Upon withdrawal, we will remove the content from our platforms as soon as possible.

Content from Minors

We do not collect or use UGC from individuals under the age of 18 without parental or guardian consent.

Ferm Living is not liable for third-party claims if you do not have the necessary rights to grant consent.

Governing Law
