Purchase agreements are contracted in Danish, English or German and are legally binding when you receive an order confirmation. All prices and offers on the webshop are without obligo.

Throughout the site, the terms “we”, “us” and “our” refer to Ferm LIVING US Inc. Ferm LIVING US Inc. offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

4. We reserve the right to refuse or cancel an order if we have reasonable grounds to believe that the customer is attempting to commit fraud or exploit our services to obtain promotional codes inappropriately.

SECTION 6 - PRODUCTS

Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product made on this site is void where prohibited. We do not warrant that the quality of any products, information or other material purchased or obtained by you will meet your expectations, or that any errors will be corrected.

 

SECTION 7 - MADE TO ORDER PRODUCTS

We offer a selection of made-to-order furniture items. Made-to-order items will be clearly marked. The expected delivery date of the product will be clearly stated on the product page, at checkout and on your order confirmation. Please expect a longer delivery time for made-to-order products. These items are custom-made specifically for you and therefore take longer to create and deliver than other items. Made- to-order products cannot be exchanged or returned. Orders for made to order items cannot be cancelled after 48 hours as the customized item will already be in the production stage.

We strive to provide the most accurate estimated arrival date for made-to-order items. However, fulfillment of made-to-order items can be delayed due to unforeseeable circumstances (delays from the supplier, the shipping carrier, natural disasters etc.) We will do our best to keep you informed of any delays to your order. You will receive an email once your made-to-order item(s) is/are ready to be shipped.

NOTE: We appreciate your interest in all of our products. If you would like to purchase items in addition to a made-to-order product, please create a separate order for them.

 

SECTION 8 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Ferm LIVING US Inc., and its parent companies and affiliates shall not be liable, directly or indirectly, or responsible to the Customer, nor be deemed to have defaulted under these terms and conditions or any other agreement or with respect to the delivery of any products to the Customer, when and to the extent such failure or delay is caused by or results from acts beyond Ferm LIVING US Inc.’s control, including, without limitation the following Force Majeure events: (a) acts of God, flood, drought, earthquake or other natural disaster; (b) epidemic or pandemic;(c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition; (f) collapse of buildings, fire, explosion or accident; [and] (g) any labor or trade dispute, strikes, industrial action or; (h) inability to obtain labor, materials or goods through Ferm LIVING US Inc.’s usual and regular sources; (i) insufficient orders; (j) non-performance by suppliers or subcontractors; (k) casualty or accident; (l) economic downturns; or (m) interruption or failure of utility service.

In such event, Ferm LIVING US Inc. may, in its sole discretion, without prior notice to Customer, at any time and from time to time postpone or extend the delivery dates under these terms and conditions for a time which is deemed reasonable in Ferm LIVING US Inc.’s sole discretion, under the circumstances. Ferm LIVING US Inc. may make partial delivery or cancel all or any portion of any contract with Customer, and any such non-performance or cancellation shall not be considered breach of these terms and conditions and/or contract or otherwise entitle Customer to any remedies.

 

SECTION 21 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New York and federal laws of the United States of America.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. DELIVERY TIME AND SHIPPING COSTS

These shipping prices you see are indicative and not for specific products. The shipping rates can vary according to the number of products and the volume. To see the specific price for your order, please go to check out and select your delivery address. Please note, that the shipping price in rare cases can be subject to change if the order includes bulky items. In such cases, you will be contacted directly by ferm LIVING US Inc. customer service upon receipt of your order.

We process your order as soon as possible. All orders are fulfilled at our warehouse in Sturtewant, Wisconsin within 1-5 business days. All customers paying by credit card, will, however, be subject to validation controls and ferm LIVING reserves the right to delay an order if we consider further security/fraud control to be necessary. When your order is shipped, we will e-mail you the tracking number of the package.

*MADE-TO-ORDER PRODUCTS
Please expect a longer delivery time for made-to-order products. These items are custom-made specifically for you and therefore take longer to create and deliver than other items. *BULKY GOODS/LARGE ORDERS AND FURNITURE
When ordering furniture or larger goods, your order will be shipped with a special courier to your delivery address. You will be contacted directly regarding the time of delivery so you will be home at the address upon delivery. If you are not at home at the agreed time of delivery, your item(s) might be returned to the warehouse. In that case, please contact us to arrange a re-delivery. The package will be delivered with curbside delivery. If curbside delivery is not possible then the goods will be delivered as close to your delivery address as possible (this service does not include removal of any packaging materials nor pallets). You are responsible for getting the goods from the curb into your house.  

The exact shipping costs for your purchase will be shown in the ordering process and depends on your order volume.

Usually, we ship the goods with TNT, UPS and LTL.
We do not deliver to PO boxes.

Please note: In the unlikely case the delivery appears damaged, we ask you to receive the goods with reservation. If the contents are damaged, please contact customer service at webshop@fermliving.com as soon as possible.

 

RETURNS POLICY

Returns

Our Return Policy lasts 30 days. If 30 days have lapsed since delivery of the goods/products to you, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Perishable goods are exempt from being returned or for a refund.

To complete your return, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer.

 

Refunds

Once your return is received and inspected, we will refund the payment.

However, we reserve the right to hold the return payment until we have received the goods you returned, or you have presented documentation confirming that you have returned the items before we have received them.

We can withhold the reimbursement until we have received the refunded items or you have sent documentation proving the return of the products.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

When you use the right of cancellation for the entire purchase, we refund all payments from you, including any standard freight charges (no return costs). However, if you choose a more expensive form of delivery than our standard delivery, we will not refund any additional costs associated with the more expensive form of delivery.

By partial cancellation, we don’t refund the freight charges.

 

Late or missing refunds

If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at webshop@fermliving.com.

 

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at webshop@fermliving.com or make a claim here

 

Shipping

To return your product, you should mail your product to: ferm LIVING US Inc., Leman,1860 Renaissance Blvd. Sturtevant, WI 53177, USA without unnecessary delay and at the latest 30 days after you notice us of your cancellation.

You will be responsible for paying for your own shipping costs for returning your item. Return shipping costs are non-refundable. Read more about cancellations and returns HERE

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
